Terms of Service
These Terms of Service ("Terms") govern your use of the Cinemak website (cinemak.app), the Cinemak desktop application, the web application at app.cinemak.app, and the Cinemak Cloud hosting service (together, the "Service"). The Service is operated by Mistral JS ("we", "us", "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Cinemak is a macOS screen-recording and editing application, paired with an optional cloud-hosting service. The desktop app records, edits, and exports video on your device. Cinemak Cloud lets paying subscribers host and share those recordings.
2. Accounts
Some features — including Pro Lifetime activation and Cinemak Cloud — require an account. You may create one with a valid email address; we authenticate you via a one-time code sent to that address.
You are responsible for keeping your account secure and for any activity that occurs under it. Notify us at nettah.safi@gmail.com if you suspect unauthorized access.
3. Plans and payment
We currently offer three plans:
- Free. Unlimited recording, editing, and 1080p / 30fps export with a small watermark. No account required.
- Pro Lifetime — $89, one-time. Watermark-free exports, 4K / 60fps export, advanced editor features, and one year of updates from the purchase date. The licence does not expire.
- Cinemak Cloud — $9 / month or $84 / year. Hosted videos, shareable links, viewer analytics, comments, and reactions. Billed in advance; renews automatically until cancelled.
Prices are in U.S. dollars and exclude any applicable taxes, which may be added at checkout. Payments are processed by Stripe; we do not receive or store your full payment-card details.
4. Subscription renewal and cancellation
Cinemak Cloud renews automatically at the end of each billing period. You can cancel at any time from your account page; cancellation takes effect at the end of the current billing period, and you keep access until then. We do not pro-rate partial periods.
5. Refunds
Our refund policy is set out in full on the Refund Policy page and is incorporated into these Terms by reference.
6. Software licence
Your use of the Cinemak desktop application is also governed by our End-User Licence Agreement (EULA). In the event of a conflict between the EULA and these Terms regarding the desktop application, the EULA controls.
7. Acceptable use
You agree not to:
- use the Service to record or share content that is unlawful, infringes someone else's rights, or violates their privacy;
- attempt to bypass licence checks, watermarks, usage limits, or other technical restrictions;
- resell, sublicense, or redistribute the Service or any part of it;
- interfere with or disrupt the Service, its infrastructure, or other users.
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.
8. Your content
Recordings and other content you create or upload remain yours. You grant us a limited licence to store, transmit, and display that content solely so we can provide the Service to you (for example, to serve a shared video to the viewer you sent a link to).
You are responsible for the content you record and share, and for having the right to record and share it.
9. Service availability
We work to keep the Service available, but we do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features at any time. If we discontinue a paid feature you have prepaid for, we will provide a pro-rata refund of the unused portion.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions the exclusions apply to the maximum extent permitted by law.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF DATA, RECORDINGS, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Our total aggregate liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law — including, for users in the European Union, statutory consumer-protection rights.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you by email or through the Service. Continued use of the Service after the changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of France. Any dispute will be submitted to the competent courts of France, without prejudice to any mandatory consumer-protection rules in your country of residence.
